Birmingham Trading Standards was waiting for legal confirmation as Mobile went to press on whether it could continue to tell thousands of Dialamobile customers to cancel their contracts with operators.
Head of Trading Standards at Birmingham council Chris Neville said: 'We invited them [operators] to get an injunction to stop us giving this advice, which they've not done. It makes me wonder if they are unsure of their legal position.'
A spokeswoman for Orange said: 'Orange is advising customers that they are bound by their contract's terms and conditions.'

Mobile Connections and Dial a Mobile Group PLC
Birmingham Trading Standards are issuing advice to customers following the closure of a premises belonging to mobile phone company, Mobile Connections.The shop in Bordesley Green closed on Thursday 30 August. Since the company was taken over by Dial a Mobile Group Plc, customers have been informed that their cash back will be provided every three months instead of monthly. The company has said that cash backs will not be honoured at the moment and no future date has been provided. Even though customers of Mobile Connections may cancel their contract with Dial a Mobile Group PLC, it will not release them from the separate contract that they have with their airtime provider and they will still be expected to pay the full monthly contract fee. Trading Standards are advising people to write to their airtime company to ask them to release them from their contract, however whether the companies do this will depend on their goodwill. Birmingham Trading Standards are attempting to meet with the airtime service providers and OFCOM, the telecommunications regulator, to try to find a resolution to this problem. MOBILE DISPUTES TEAM HAS BEEN LOOKING INTO WHY? AND AFTER READING MANY ARTICLES ITS ALL CLEAR.

In a nutshell since August 2007 OFCOM started a new code of practise for the five UK NETWORK OPERATORS, as ofcom was receving over 400 complaints per month, which then made is difficult and in some case impossible for the MOBILE DEALERSHIPS to continue trading and offering the so called cashback system as the network operators reduced there commision and tightened up on the procedures this then had an effect on the UK CONSUMERS whom had taken these cashback deals as they were relying on there cashback for the Mobile Phones they have with the network. ......
